Sinair Travel Sdn Bhd shall be referred to as “The Company” in the following. Working days refer to Monday to Friday excluding public holidays. By making a reservation with The Company, you and your travel companion are deemed to have read, understood and accepted the following terms and conditions.

The purchase of any travel service offered by The Company constitutes a contractual arrangement between you and The Company and represents your acceptance of The Company’s terms and conditions as set out herein. You represent and warrant that you are authorized to accept The Company’s Terms and Conditions on behalf of everyone named in your booking and will be deemed to have accepted The Company’s Terms and conditions on behalf of everyone named in your booking.

1. RESERVATION, DEPOSIT AND FULL PAYMENT
1.1 The deposit payable per person at the time of booking is as follow

1.2 The Company reserved the right to request for a top-up on initial deposit for immediate issuance of air ticket, to avoid incurring additional surcharges of fares different.

1.3 Does not constitute confirmation of the tour.
i. All group tours are subject to a minimum group size (as determine by The Company) in order for the confirmation to be effected and for the departure to be finalized.
ii. The Company acts as an agent for service suppliers. After deposit or full payment has been made, all arrangements are still subject to final confirmation by service suppliers.

1.4 Full payment must be received by The Company not less than twenty one (21) working days before the designated departure date. A failure to comply with this requirement may result in the cancellation of reservation and a cancellation fee in accordance with clause 2.1 below, and to apply the deposit toward settlement of the cancellation fee, with any balance owing to be payable within 10 working days, without any recourse by the customer against The Company.

2. CANCELLATION BY THE CUSTOMER
2.1 Cancellation of booking must be made in writing or in person before the designated departure date. The below specified per person cancellation fees apply

2.2 The above cancellation fees apply if the air ticket are not issued. If the air tickets are issued or the fare already paid to the particular airlines, the value of the air ticket will be added onto the cancellation fees. Should the deposit amount is insufficient to meet the ticket/ cancellation fee, the customer must settle the shortfall within 10 working days. The respective airline’s cancellation policy shall apply in addition to the cancellation charges as set out in clause 2.1. The airlines ticket is restricted and subject to the airline’s Terms and conditions. It may be non-endorsable, non Re-issuable and non refundable. Any alteration in routing or change of date of travel by any passenger is solely at their own risk. The company or its associated agents shall not be held responsible for any inconvenience caused and extra expenses incurred.

3. CANCELLATION BY THE COMPANY & CUSTOMER
3.1 The Company reserves the right to cancel , advance or postpone any schedule tour date in accordance with operational requirement , insufficient passengers, inability to secure seat, inability to confirm the service of the third party suppliers (including but not limited to cruises, overseas land operator, trains, ferries, motor coaches, hotel and restaurant) or circumstances which beyond the company control. In the event of cancelation by The Company, The Company may, but shall not be obliged to, recommend on alternative tours to either the same or another destination to The Customer. Additional charges may apply for such alternative package tour. Any resulting additional expenses will be payable by The Customer and any resulting saving will be refunded by The Company to Customer. If no alternative Tour are offered or should The Customer decided not to accept any alternative offered, The Company will fully refund all payment received from the Customer for the applicable package tour, without interest, in full discharge of our obligations to The Customer.

3.2 The Company or The Customer may at any time cancel, change the itinerary, advance or postpone any schedule tour due to travel restriction, natural disaster, diseases weather conditions, war, strike, riot or any travel advisory issued advising against travel to one or more of the destinations included in our Package Tour, during the proposed period of travel. In such instance, Customer may still be responsible for all fees imposed by the respective airline, hotel or other service suppliers if any. The Company shall also not be held liable for any contingent costs incurred by The Customer arising from this cancellation, advancement or postponement.

4. AMENDMENT BY CUSTOMER
4.1. For any changes on designated itinerary, departure date, tour type or traveler’s name by Customer for any reason is considered a cancellation, and a cancellation fee, as stated in clause 2 above may apply and the respective airlines cancellation rules and fees will apply in addition to the above cancellation fee. Where the changes is available, The Customer shall be responsible for all additional charges and administrative fee that may be incurred to effect the change.

5. AMENDMENT TO TOUR ITINERARY BY COMPANY
5.1. The Company makes best effort to avoid changes in the itinerary. However, The Company reserve the right to make changes at any time due to unforeseen circumstances, especially during peak periods or in the event of other circumstances beyond The Company control. The Company will not be responsible for any loss, expenses, or any inconvenience caused by reason of such changes.

6. REFUND POLICY
6.1 After commencement of the tour, no refund will be made to any Customer in respect of airfare, accommodation, meal, transport, sightseeing tours or any other services which are included in the tour fare but not utilized by The Customer due to personal reasons or voluntary modifications by The Customer itself.

6.2 For ticket with refund value, will only be refunded to Customer after the respective airlines have refunded to The Company. The standard processing period for air ticket refund various from one (1) to six (6) months subject to the respective airlines practice.

7. EXTENSION OF STAY/DEVIATION
7.1 Request for an extension of stay or deviation from the tour itinerary must be informed at the time of booking and is subject to tour fare different and confirmation by airlines and other related service suppliers. If, for any reason, The Company are unable to confirm The Customer request, the request shall be deemed withdrawn and The Customer shall be deemed to have consented to the original itinerary.

7.2 Cancellation fees as stated in clause 2 is also applicable if The Customer cancel the booking due to extension / deviation is unable to confirm prior to departure.

8. TRAVEL DOCUMENTS, VISA
8.1 It is traveler’s / customer’s solely responsibility to ensure that:
A) They have a valid passport with minimum six (6) months validity from the date of schedule return back to the country of origin.
B) They have all necessary visas, permits, vaccinations, health certificates and other approval or documents as required by the various authorities of the countries to be visited.

8.2 Visa – The Company may assist to submit a visa application with a fee, but do not guarantee the approval on any such application.

9. ACCEPTANCE OF RISK
During the tour organized by The Company, certain risks and dangers may arise beyond our control, including but not limited to : hazards of travelling in undeveloped area, travel by boat, train, automobile, aircraft or other means of transportation, forces of nature; political unrest ; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation of medical facilities, The Company will not liable for the provision of medical care or the adequacy of any care that may be rendered. While The Company will use its best efforts to ensure that adequate measures are taken. By agreeing to participate in a tour and /or optional excursions you agree that you will not hold The Company harmless regarding any provision of medical care or the adequately of any care rendered.

10. INSURANCE
The Company strongly recommends all customers take out comprehensive travel insurance to protect against unforeseen circumstances, such as loss of luggage, medical expenses, personal liability, flight delays etc… The Company shall not be responsible, under any circumstances for any such matters. Should there be any amendment to the date and duration of travel, it is customer’s responsibility to inform the insurance company to amend the date and duration of the insurance coverage.

11. PARTICIPATIONS
The Company reserves the right to accept or reject any traveler or to remove any tour member whose conduct is deemed uncooperative with tour leader or Tour Guide or incompatible with the interests, harmony and welfare of other tour members. The Company will not refund or cover any cost or expenses incurred for termination of tour arrangements due to this and The Company shall be under no further liability thereafter to any such tour member (s).

12. EXCLUSION OF LIABILITY
A) In making the travel arrangement, The Company and /or its associated agents act only as an agent for the suppliers ( including but not limited to : airlines, trains, cruises, ferries, motor coaches, land or optional tour operator, hotel and restaurant). All the services provided are subject to the terms and conditions specified by the supplier and to the law of the countries in which the services are supplied. Whilst we will endeavor to render reasonable assistance to our Customers wherever possible, we have no control over these suppliers and shall not be liable, in any way, for any changes made by or acts or omissions of these suppliers.
B) Third party suppliers (including but not limit to train, cruises, ferries, motor coaches, optional local tour operator, hotels and restaurant) providing optional activities and excursions available for booking are not run, supervised or controlled in any way by The Company. Such service do not form any part of the product or service sold by The Company, even where The Company suggests particular operator or other third parties and / or assist in booking such services. Customer’s contract for the services will be with the Supplier and will be subject to its Terms and Conditions, which may contain exclusion or limitations of liability. The Company has no liability for any such activity or excursion or for any act or omission of the supplier or its employees or agents or any other person connected with the service.

13. RIGHT, DISCLAIMERS AND INDEMNITY
Without limiting any other provision of these Terms and Conditions, to the fullest extent permitted by law, The Company shall not be responsible or assume any liability to any Customer or traveler for:
i. Deportation or refusal of entry by immigration Authorities due to processing unlawful items or holding improper travel document or other causes or whose behavior and activities are considered as subversive by the foreign government concerned.
ii. Any injury, loss, damage, cost, expenses or delay suffered or incurred due to circumstances beyond The Company reasonable control ,including but not limited
a) Action or omissions of third parties (including any applicable third party service providers)
b) Mechanical breakdowns
c) A force majeure event
d) A failure by the Customer or traveler to comply with any of his or her obligations hereunder
e) A failure by The Customer or traveler to follow reasonable instruction, including but not limited to noting any complying with specified check in and check out and /or meeting places and times.

To the fullest extent permitted by law, The Company maximum liability to any Customer or traveler for any loss, damage, cost and /or expense shall in no event exceed the amount of the package tour fare paid to and received by The Company in respect of such customer or traveler.

In no event shall The Company be liable for any punitive special, indirect or consequential loss or damage, including loss of production, profit, revenue or contract or loss of or damage to goodwill or reputation. You agree to indemnify The Company, our affiliates and our respective officers, directors and employees, immediately on demand, against all claims, liabilities, damages, costs and expenses, including legal fees (on a Full indemnity basis), arising out of any breach of these Terms and Conditions by you.

CHILD FARE
Children under 12 years old (as of the date of return to the last destination) may eligible for child fare rates in accordance with the applicable third party service provider’s standard terms. Child fare is based on sharing room with two adults. A surcharge will be imposed for a child who occupies a room with only one adult.

YOUNG TRAVELLERS
Travelers under 18 years old on the schedule departure date must be accompanied by an adult (his or her parent or official guardian). It is also the traveler’s sole responsibility to ensure that the requirements of any relevant airline and /or regulatory authority relating to minors are complied with.

PREGNANT TRAVELERS
It is the responsibility of pregnant travelers to ensure that they have doctor’s certification that they are fixed for travel. Without any such doctor’s certificate, third party providers, such as airlines or cruise companies, have the sole discretion to disallow a pregnant traveler to board the relevant flight or cruise or to undertake certain activities and no refund shall be made in such event.

TRAVELERS WITH SPECIAL NEEDS
Travelers must inform the company at the time of booking for any disability requiring special attention while on tour, on flight, on train or on a cruise. The company will make reasonable attempts to accommodate the special needs of disables travelers but shall not be responsible if the company are unable to effect any requested arrangements. The company also not be responsible for any denial of services by airlines, hotels, restaurants or other third party service providers. The company cannot provide individual assistance to any traveler for walking, dining, getting on or off cruise ships, motor coaches and other vehicles or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well-being. The company is not responsible for any missed activities due to a traveler’s inability to participants with the group.

ACCEPTANCE OF RISK- DIETARY REQUIREMENTS
Travelers must inform the company at the time of booking for any special dietary requirements and allergies. The company will use its best efforts o cater. However, the company cannot guarantee that certain products will not be in food served. The company will not accept any liability in relating to any medical conditions, special dietary requirement or allergies of travelers, even if such conditions are informed by the travelers to the company. Travelers must make their own decisions when selecting meals. The company’s comments are a=only to assist you in making an informed decision.

ACCOMODATIONS
Room and bed preference may be requested, but are not guaranteed. Occasionally, some hotels will only provide doublebedded rooms. Triple rooms are usually no larger than twin or double rooms and the additional bed may be a “roll away” bed. Single room occupancy is usually at additional cost.

CONFIDENTIALITY AND PRIVACY
A) Customer or travelers warrants that he/she has given consents to the processing of their Personal Data by The Company to the Airlines, Governmental authorities, hotel, cruises or other Third Party Suppliers for the purpose of the ticket or tour arrangement. The company considers every transaction confidential and will not disclose any information without customer permission, unless required by the rules and law.
B) We may take photographs and video of travelers participating in our package tours for our advertising and publicity media. By joining our package tour, all travelers shall be deemed to have consented to such collection and/or use on our part. Notwith standing, any traveler who wishes to withdraw his or her consent to our collection or use of any photographs or videos that may feature such traveler, may notify us before departure [email protected].
